Newsletter Offer Terms

These terms apply to the “10% off your first order” welcome offer for new FACTOVAL email subscribers (the “Offer”). The Offer is provided by Magnivast LLC, doing business as FACTOVAL. Our Terms of Service also apply.

1. How to get the Offer

  • Sign up for FACTOVAL marketing emails using the sign-up form on our Site, with a valid email address that you own, and agree to receive marketing emails.
  • After you sign up, we will show your one-time code on screen and send it to your email address. Codes begin with “WELCOME-.”
  • No purchase is needed to sign up. You can unsubscribe at any time (see Section 5).

2. Who is eligible

  • New subscribers who have not placed an order with FACTOVAL before.
  • Customers who are at least 18 years old with a U.S. shipping address.
  • One welcome code per customer. We may decline to honor a code if we reasonably determine that the same person or household has already received or used a welcome code or has ordered from us before, for example based on name, shipping address, or payment method.

3. How to use your code

  • Enter the code at checkout. You must check out using the same email address you used to sign up.
  • The code gives 10% off the merchandise subtotal of your first order.
  • The code does not apply to shipping charges or sales tax.
  • The code can be used once, on your first order only.
  • The code expires 30 days after it is issued.
  • The code cannot be combined with any other discount code or promotion.
  • The code cannot be applied to an order that has already been placed.
  • The code has no cash value, cannot be exchanged for cash or credit, and cannot be transferred, sold, or published (for example, on coupon websites). We may deactivate codes that are shared publicly.

4. How the discount affects shipping and refunds

  • Free shipping: our free standard shipping threshold of $150 is based on your merchandise subtotal before discounts, so using the welcome code never causes you to lose free shipping. For example, a $160.00 order with the 10% code costs $144.00 for the merchandise and still ships free. See our Shipping Policy.
  • Returns: if you return items from an order that used the code, your refund is based on the discounted price you actually paid. The discount is spread proportionally across the items in the order. See our Return & Refund Policy.
  • Cancelled orders: if you cancel your entire first order before it ships, contact us and we can issue a replacement code with the same expiration date.

5. Marketing emails

  • By signing up, you agree to receive marketing emails from FACTOVAL about our products, offers, technical articles, and store news. The number of emails varies.
  • Every marketing email includes an unsubscribe link. You can also unsubscribe by emailing contact@factoval.com. We process unsubscribe requests within 10 business days.
  • If you unsubscribe after receiving your code, the code remains valid until it expires.
  • Even after you unsubscribe, we will still send emails about your orders and account (for example, order confirmations and shipping notices).
  • We do not send marketing text messages as part of this Offer.

6. Privacy and notice of financial incentive

We handle your email address and sign-up information as described in our Privacy Policy. Under California law, the Offer may be considered a “financial incentive.” In summary:

  • Information involved: your email address, the date, time, and page where you signed up, your consent record, and limited technical information (such as IP address) used to prevent abuse.
  • How to opt in: submit the sign-up form and agree to receive marketing emails.
  • How to withdraw: unsubscribe at any time. A code already issued remains valid until it expires.
  • Value of your data: we estimate that the value of your email address and permission to send you marketing emails is reasonably related to, and approximately equal to, the value of the discount (10% of the merchandise subtotal of your first order; for example, $4.00 on a $40.00 order). This estimate is based on the expected cost of the discount compared with the expected revenue and marketing expenses connected with our email program.

7. Changes and abuse

  • We may change or end the Offer at any time for future sign-ups. Codes already issued will be honored under the terms in effect when they were issued, until they expire.
  • We may cancel codes, or cancel and refund orders, that we reasonably believe were obtained through fake or multiple email addresses, automated sign-ups, or other abuse of the Offer.
  • The Offer is valid only on factoval.com for shipments to U.S. addresses.
