Terms of Service

Last updated: October 8, 2026

These Terms of Service (“Terms”) govern your use of factoval.com (the “Site”) and your purchase of products from us. The Site is operated by Magnivast LLC, doing business as FACTOVAL (“FACTOVAL,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or place an order.

Important safety notice: many of our products are chemicals, and some are hazardous materials, including flammable aerosols, butane fuel canisters, and fuels. Always read and follow the product label and the Safety Data Sheet (SDS) before use. See our Prop 65 & Product Safety page.

1. Who we are and how to contact us

  • Business: Magnivast LLC, doing business as FACTOVAL
  • Email: contact@factoval.com
  • Phone: (551) 401-4841
  • Business address: 312 W. 2nd St, Casper, WY 82601, USA
  • Orders ship from: our third-party fulfillment warehouse in Pennsauken, New Jersey (no customer pickup)

2. Related policies

The following policies are part of these Terms. Please read them before you buy:

If these Terms conflict with a specific policy listed above on the topic that policy covers, the specific policy controls.

3. Who can buy from us

  • You must be at least 18 years old to place an order. We do not sell to minors.
  • We ship only to addresses in the United States. Some products cannot be shipped to certain states or territories, to P.O. Boxes, or to military (APO/FPO/DPO) addresses. See our Shipping Policy.
  • We do not ship to freight forwarders or package reshipping services, and you agree not to export products you buy from us.
  • If you buy on behalf of a business, you confirm that you are authorized to bind that business to these Terms.

4. Accounts

You may check out as a guest or create an account. If you create an account, you are responsible for keeping your password confidential and for activity under your account. Please tell us right away if you believe your account has been used without your permission. We may suspend or close accounts that are used in violation of these Terms.

5. Products, safety, and intended use

  • Read the label and SDS. Our products include lubricants, greases, penetrating oils, silicone sealants, contact cleaners, aerosols, and fuels. Many are formulated for industrial, professional, maintenance, and technical use. You are responsible for choosing a product that is suitable for your application, following all label directions and warnings, using appropriate ventilation and protective equipment, and storing and disposing of products as the label, the SDS, and local law require.
  • Flammable products. Keep flammable aerosols, butane, and fuels away from heat, sparks, open flames, and hot surfaces. Aerosol cans and fuel canisters can burst if exposed to temperatures above 120°F (49°C). Use fuel-burning appliances only as their manufacturer directs, and only in well-ventilated areas, because burning fuel produces carbon monoxide.
  • No misuse. Deliberately concentrating and inhaling the contents of aerosol or fuel products can be harmful or fatal. Do not use products on or in the human body, or for food-contact uses, unless the product label specifically says the product is suitable for that use.
  • Product information. We try to make product descriptions, images, specifications, and documents accurate. Product information, Safety Data Sheets, and technical documents come from the manufacturers and are provided for your convenience. Manufacturers may change formulas, packaging, or labels without notice, and the label and SDS supplied with the product control. If we find a material error in a product listing, we will correct it.
  • Restricted products. We may refuse, limit, or cancel an order for a product that cannot lawfully or safely be sold or shipped to your address (for example, because of state air-quality rules on certain aerosol and solvent products, or carrier rules for hazardous materials), or for quantities that suggest the order is not for the buyer’s own use.

6. Prices, currency, and taxes

  • All prices are in U.S. dollars (USD).
  • Prices shown on the Site do not include sales tax, and do not include shipping unless stated. Shipping charges are described in our Shipping Policy.
  • We collect sales tax where we are required to by law. Tax is calculated at checkout based on your shipping address and the products you buy, and is shown as a separate line before you pay.
  • For example, we are registered with the State of New Jersey and collect New Jersey sales tax (currently 6.625%) on orders shipped to New Jersey addresses, including on shipping charges where New Jersey law requires it. Butane and chafing fuel are treated as exempt fuel under New Jersey law, so no New Jersey sales tax is charged on them.
  • If you are exempt from sales tax (for example, for resale), please contact us before you order with a valid exemption certificate.
  • Prices and availability may change at any time, but a change will not affect an order we have already accepted, except as described below for errors.
  • Pricing errors: if a product is listed at an obviously incorrect price because of a typographical or system error, we may cancel the order for that product before it ships and refund any amount charged for it, or contact you to ask whether you want to buy it at the correct price.

7. Payment

  • We accept major credit and debit cards (Visa, Mastercard, American Express, Discover) and Link (Stripe’s saved-payment feature). All payments are processed securely by Stripe. We do not receive or store your full card number. If you use Link, Stripe’s terms and privacy policy for Link also apply.
  • By placing an order, you confirm that you are authorized to use the payment method, and you authorize us (through Stripe) to charge the order total, including taxes and shipping, when you place your order.
  • Charges will appear on your card or bank statement as MGV* FACTOVAL. “MGV” stands for Magnivast LLC, the company that operates FACTOVAL.
  • Orders may be reviewed for fraud. We may cancel any order we reasonably believe is fraudulent or unauthorized, and we will refund any amount charged.
  • If you see a charge you do not recognize or have a problem with an order, please contact us first. We can usually resolve the issue faster than a card dispute.

8. Orders, acceptance, and cancellation

  • Your order is an offer. When you place an order, you are offering to buy the products in your cart. The order confirmation email confirms that we received your order; it is not yet our acceptance. We accept your order when we ship it and send you a shipping confirmation.
  • Our right to decline or cancel. We may decline or cancel all or part of an order because of product availability, a pricing or listing error, shipping restrictions, a failed or suspicious payment, incorrect or incomplete information, or a violation of these Terms. If we cancel after you have been charged, we will refund the amount charged for the cancelled items within 7 business days.
  • Delays. If we cannot ship your order within the time stated in our Shipping Policy, we will notify you and give you the choice to agree to the delay or cancel for a full refund, as described in that policy.
  • Your right to cancel before shipment. Please contact us as soon as possible if you want to cancel. If your order has not yet been processed for shipment, we will cancel it and issue a full refund. Once an order has shipped, our Return & Refund Policy applies.
  • Quantity limits. We may limit the quantity of a product that can be bought per order or per customer.

9. Shipping, title, and risk of loss

Shipping options, delivery estimates, and destination restrictions are described in our Shipping Policy. Title to products passes to you when we hand them to the carrier. Risk of loss passes to you when the carrier delivers the package to the shipping address you gave us. Until then, we are responsible for loss or damage in transit and will handle it as described in our Shipping Policy and Return & Refund Policy.

10. Returns and refunds

Returns and refunds are governed by our Return & Refund Policy. Because of safety and transportation rules, hazardous items (such as aerosols, butane, and fuels) and opened chemical products cannot be returned unless they arrived damaged or defective or we sent the wrong item.

11. Promotions and discount codes

Discount codes and promotions are subject to the terms shown with the offer, including our Newsletter Offer Terms. Unless the offer says otherwise, only one code can be used per order, codes have no cash value, and codes cannot be applied to orders already placed. We may cancel codes or orders obtained through fraud, multiple or fake accounts, or other abuse of an offer.

12. Warranties

  • Manufacturer warranties. Products are covered only by any warranty the manufacturer provides. We do not give our own written warranty on products. If you have a warranty question, contact us and we will help you reach the manufacturer.
  • Consumers. If you buy as a consumer (for personal, family, or household use), you keep any implied warranties that the law of your state provides, such as the implied warranty of merchantability, and nothing in these Terms excludes or limits them.
  • Business purchasers. IF YOU BUY FOR BUSINESS PURPOSES, AND EXCEPT FOR ANY MANUFACTURER WARRANTY, PRODUCTS ARE SOLD “AS IS,” AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
  • The Site. We work to keep the Site available and accurate, but we do not promise that the Site will always be available, uninterrupted, or free of errors or harmful components.

13. Limitation of liability

We are not liable for indirect, incidental, special, or consequential damages, such as lost profits, lost business, or business interruption, arising from your use of the Site or products bought from us. Our total liability for any claim relating to a product is limited to the amount you paid for that product.

This section does not limit or exclude our liability for (a) death or personal injury caused by our negligence; (b) our fraud, fraudulent misrepresentation, gross negligence, or willful misconduct; (c) consumer implied warranties described in Section 12; or (d) any other liability that the law does not allow us to limit or exclude.

14. Your responsibility to us

You agree to reimburse us for losses, damages, and reasonable costs (including reasonable attorneys’ fees) arising from third-party claims to the extent they are caused by (a) your breach of these Terms, (b) your violation of law, or (c) your resale, relabeling, repackaging, or use of products contrary to the product label or SDS. This section does not require you to reimburse us for losses caused by our own negligence or misconduct.

15. Reviews and content you submit

  • You may post honest reviews and comments about products you bought. Nothing in these Terms restricts your right to post an honest review, including a negative one.
  • By posting content, you give us a non-exclusive, royalty-free license to display, reproduce, and use it on the Site and in our marketing, and you confirm that it is truthful and that you have the right to post it.
  • We publish both positive and negative reviews. We may remove content that is spam, off-topic, about a different product, abusive, unlawful, or that includes personal information, and we apply these standards equally to positive and negative reviews.
  • We do not offer anything of value in exchange for a review of a particular rating or sentiment. If we ever offer an incentive for reviews, it will not depend on whether the review is positive or negative, and incentivized reviews will be clearly identified. Reviews by our employees or their family members will be clearly identified.

16. Acceptable use of the Site

You agree not to:

  • use the Site for any unlawful or fraudulent purpose, or submit false information;
  • try to gain unauthorized access to the Site, our systems, or other users’ accounts;
  • interfere with the operation or security of the Site, including by introducing malware or overloading it;
  • use bots, scrapers, or other automated tools to collect content or place orders without our written permission; or
  • test stolen or unauthorized payment cards.

We may restrict or end your access to the Site if we reasonably believe you have violated these Terms.

17. Intellectual property and third-party brands

The Site’s content, including text, graphics, the FACTOVAL name and logo, page layouts, and photographs we create, is owned by or licensed to us and may not be copied or used commercially without our written permission. Product names, brand names, logos, and trademarks of manufacturers (such as Super Lube, ASI, DeoxIT, Kroil, and Gas One) belong to their respective owners. Their use on the Site identifies the products we sell and does not mean that those manufacturers sponsor or endorse FACTOVAL, unless we state otherwise.

18. Third-party links and services

The Site may link to or use third-party websites and services, such as manufacturer websites, Stripe, carrier tracking pages, and order-tracking tools. We are not responsible for third-party websites or services, and your use of them is subject to their own terms and policies.

19. Product recalls and safety notices

If a manufacturer or a government agency announces a recall or safety notice for a product you bought from us, we may contact you using the information from your order so that you can take appropriate action.

20. Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, natural disasters, carrier or supply-chain disruptions, labor disputes, government actions, or utility or internet outages. If such an event affects your order, we will keep you informed and you may cancel any order that has not yet shipped for a full refund.

21. Disputes and governing law

  • Contact us first. Most concerns can be resolved quickly. Before starting a legal claim, please email us at contact@factoval.com with a description of the problem and the outcome you are asking for, and give us 30 days to try to resolve it.
  • Small claims. Either you or we may bring an individual claim in a small claims court that has jurisdiction.
  • Governing law. These Terms and any purchase from us are governed by the laws of the State of New Jersey, where our orders ship from, and applicable U.S. federal law, without regard to conflict-of-law rules.
  • Where claims are heard. Any claim not brought in small claims court will be heard in the state or federal courts located in Camden County, New Jersey. If you are a consumer, you may instead bring a claim in the courts of the county and state where you live.
  • Your consumer rights. If you are a consumer, nothing in these Terms deprives you of the protection of the consumer protection laws of the state where you live that cannot be changed by contract.

22. New Jersey residents

If you are a New Jersey resident:

  • Section 13 (Limitation of liability) does not limit or exclude our liability for property damage or personal injury, for our negligence, recklessness, or intentional misconduct, for punitive damages where permitted by the New Jersey Punitive Damages Act, or for claims under the New Jersey Products Liability Act or the New Jersey Consumer Fraud Act.
  • Section 14 (Your responsibility to us) does not require you to reimburse us for losses caused by our own negligence or misconduct, and does not require you to pay our attorneys’ fees except as a court may order under applicable law.
  • The business-purchaser disclaimer in Section 12 does not apply to you if you buy as a consumer.

23. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the “Last updated” date. Changes apply only to use of the Site and orders placed after the updated Terms are posted. Your order is governed by the Terms in effect when you placed it.

24. General

  • Severability: if a court finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the extent permitted, and the rest of these Terms will remain in effect.
  • Entire agreement: these Terms and the policies listed in Section 2 are the entire agreement between you and us about the Site and your purchases.
  • No waiver: if we do not enforce a provision, that does not waive our right to enforce it later.
  • Assignment: we may transfer our rights and obligations under these Terms to a successor business. You may not transfer yours without our written consent.
  • Notices: we may send notices to the email address you give us. You may send notices to contact@factoval.com or to our business address.
  • Language: these Terms are written in English, and the English version controls.
