This Privacy Policy explains how Magnivast LLC, doing business as FACTOVAL (“FACTOVAL,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information when you visit factoval.com (the “Site”), place an order, sign up for our emails, or contact us. It also explains the choices and rights you have. This policy also serves as our notice at collection for California residents.
Summary
- We collect the information we need to sell and ship products to you: your contact details, shipping and billing addresses, order history, and basic information about your device and how you use the Site.
- Payments are processed by Stripe. We never see or store your full card number.
- We do not sell personal information for money. If we use advertising cookies, some state laws may treat that as a “sale,” “sharing,” or “targeted advertising.” You can opt out at any time, and we honor the Global Privacy Control (GPC) browser signal.
- You can ask to access, correct, delete, or receive a copy of your personal information by emailing contact@factoval.com.
1. Who we are
The business responsible for your personal information is Magnivast LLC, a U.S. limited liability company doing business as FACTOVAL, 312 W. 2nd St, Casper, WY 82601, USA. We sell only to customers with shipping addresses in the United States. Orders ship from our third-party fulfillment warehouse in Pennsauken, New Jersey.
If you have questions about this policy or our privacy practices, contact us at contact@factoval.com (subject line: “Privacy”) or by phone at (551) 401-4841.
2. Personal information we collect
“Personal information” means information that identifies, relates to, or can reasonably be linked to you or your household. It does not include information that has been de-identified or aggregated so that it can no longer be linked to you.
Information you give us
- Contact and identity details: name, email address, phone number, billing address, shipping address, and (optionally) company name.
- Order details: the products you buy, quantities, prices, discount codes, shipping method, order notes, and any cancellation, return, or refund requests.
- Account details (optional): if you create an account, your email address or username, password (stored in encrypted, hashed form), saved addresses, and order history. You can always check out as a guest instead.
- Communications: messages you send us by email, phone, or our contact form, and product reviews or comments you post on the Site.
- Business purchasing details (if you provide them): sales tax exemption or resale certificates, purchase order numbers, and business contact details.
- Email sign-up details: your email address, the date, time, and page where you signed up, and your consent to receive marketing emails.
Payment information
Payments are processed by Stripe. When you pay by credit or debit card or Link, your payment details are entered into Stripe’s secure payment fields and sent directly to Stripe. We do not receive or store your full card number or security code. Stripe shares limited information with us, such as the card brand, the last four digits, the expiration date, billing ZIP code and country, whether the payment succeeded, and fraud-risk signals.
Link is Stripe’s saved-payment feature. If you choose to save your details with Link or pay with Link, your payment details and the contact and shipping details you save are stored in your Link account with Stripe, not with us, and Stripe handles them under its own terms and privacy policy. When you use Link at checkout, Stripe shares with us the contact and shipping details you choose to use for that order.
Information collected automatically
- Device and connection information: IP address, browser type and version, operating system, device type, language settings, and the website that referred you.
- Usage information: pages and products you view, items you add to your cart, searches on the Site, the date and time of your visit, and steps you take at checkout.
- Approximate location: a general location (such as city or state) inferred from your IP address. We do not collect precise geolocation.
- Cookies and similar technologies: see Section 5.
Information from other sources
- Stripe (payment status and fraud-prevention signals, and, if you use Link, the contact and shipping details you choose to fill in from your Link account).
- Shipping carriers and our fulfillment warehouse (tracking events, delivery confirmation, and address corrections).
- Analytics and advertising partners, if we use them (for example, reports on how our ads perform).
Sensitive personal information
The only “sensitive” personal information we process is your account login (email address or username together with your password), if you choose to create an account. We use it only to provide and secure your account. We do not use sensitive personal information to infer characteristics about you. We do not ask for, and you should not send us, Social Security numbers, driver’s license numbers, health information, or similar sensitive data.
3. How we use personal information
- To process and deliver your orders: taking payment, preparing and shipping your order, providing tracking, handling cancellations, returns, refunds, and warranty questions.
- To ship hazardous and regulated products safely and lawfully: checking that a product can be shipped to your address (for example, ground-only hazardous materials or state product restrictions) and providing Safety Data Sheets and safety notices.
- To communicate with you: order confirmations, shipping notices, notices about delays, account messages, responses to your questions, and product safety or recall notices.
- For marketing, with your choice: sending newsletters and promotional emails if you sign up, issuing the welcome discount code described in our Newsletter Offer Terms, and measuring how our emails perform. You can unsubscribe at any time.
- For analytics and improvement: understanding how the Site is used, fixing errors, and improving our pages, products, and service.
- For advertising, if enabled and subject to your opt-out rights: measuring the results of our ads and showing our ads to you on other websites and apps.
- For security and fraud prevention: detecting and preventing fraudulent orders, card testing, abuse of discount codes, and attacks on the Site.
- For legal, tax, and accounting purposes: calculating, collecting, and remitting sales tax where required, keeping business records, responding to lawful requests, enforcing our Terms of Service, and defending legal claims.
- For business transfers: as part of a merger, acquisition, financing, or sale of all or part of our business, subject to this policy.
We do not use automated decision-making that produces legal or similarly significant effects about you. Stripe’s fraud tools may automatically decline a payment that appears high-risk. If that happens, please contact us and we will review it.
4. How we disclose personal information
Service providers
We share personal information with companies that perform services for us. They may use it only to provide those services to us and must protect it. These include:
- Payment processing: Stripe, Inc. (cards, Link, and fraud prevention). Stripe’s privacy policy is available at stripe.com/privacy.
- Website hosting and e-commerce software: our web hosting provider and the WordPress and WooCommerce software and extensions that run the Site.
- Order fulfillment: our third-party warehouse in Pennsauken, New Jersey, which receives your name, shipping address, phone number, and order contents.
- Shipping carriers: USPS, UPS, and FedEx, which receive your name, shipping address, phone number, and package details.
- Order tracking: the tracking tool on our Track Your Order page (17TRACK) receives the tracking number you enter and standard device information.
- Email delivery: providers that send our transactional and marketing emails.
- Professional and business services: accountants, tax and bookkeeping providers, lawyers, auditors, insurers, and IT support.
Advertising and analytics partners
If we enable analytics or advertising tools (such as Google Analytics, Google Ads, or the Meta Pixel), those companies may collect online identifiers and information about your activity on the Site through cookies and similar technologies. They may also use that information for their own purposes under their own privacy policies, including to show you ads on other websites. Some state laws treat this as a “sale” or “sharing” of personal information or as “targeted advertising.” You can opt out as described in Section 7.
Other disclosures
- Product manufacturers: when needed to handle a warranty claim, a product question you ask us to forward, or a product safety recall.
- Legal and safety reasons: to comply with law, regulation, subpoenas, or other legal process; to protect the rights, property, or safety of FACTOVAL, our customers, or others; and to detect and prevent fraud.
- Business transfers: to a buyer, successor, or financing party in connection with a merger, acquisition, or sale of assets.
- With your direction or consent: when you ask us to share information with someone else.
What we do not do
- We do not sell personal information for money.
- We do not knowingly sell or share the personal information of consumers under 16 years of age.
- We do not disclose personal information to third parties for their own direct marketing purposes.
Categories disclosed in the last 12 months
In the 12 months before the date of this policy (including the period before October 2026 when our store ran on a previous hosted e-commerce platform, which acted as our service provider), we disclosed the following categories of personal information for business purposes:
- Identifiers (such as name, email address, postal address, phone number, IP address, and online identifiers): to payment, hosting and platform, fulfillment, shipping, email, and professional service providers.
- Customer records (such as name, address, phone number, and limited payment details): to payment, fulfillment, shipping, and professional service providers.
- Commercial information (such as products purchased and returned): to payment, hosting and platform, fulfillment, and professional service providers.
- Internet or other electronic network activity (such as browsing and cart activity on the Site): to hosting and platform providers and, if enabled, analytics and advertising partners.
- Approximate geolocation (derived from IP address): to hosting and platform providers and, if enabled, analytics and advertising partners.
Where online identifiers and internet activity were made available to advertising or analytics partners through cookies, we treat that as “selling” or “sharing” under applicable law and honor opt-out requests for it. We do not sell or share sensitive personal information.
5. Cookies and similar technologies
Cookies are small files stored in your browser. We use the following types:
Strictly necessary cookies
These make the Site and checkout work and cannot be turned off in our systems (you can block them in your browser, but the cart and checkout will not work). They include WooCommerce cart and session cookies (such as woocommerce_cart_hash, woocommerce_items_in_cart, and wp_woocommerce_session_), WordPress login cookies if you sign in to an account, caching and security cookies from our hosting provider, and Stripe cookies used to prevent payment fraud and, if you use Link, to recognize your Link account (such as __stripe_mid and __stripe_sid), which are set when the payment form loads.
Analytics cookies (only if enabled)
Analytics tools, such as Google Analytics, help us understand how visitors use the Site (for example, which pages are viewed and where visitors leave checkout). We use these reports in aggregate.
Advertising cookies and pixels (only if enabled)
Advertising tools, such as Google Ads and the Meta Pixel, help us measure our ads and show our ads to people who have visited the Site. These third parties may collect personal information about your online activities over time and across different websites and apps.
Your cookie choices
- Use the “Your Privacy Choices” link at the bottom of every page to opt out of analytics and advertising cookies that count as a sale, sharing, or targeted advertising.
- Turn on Global Privacy Control in your browser (see below).
- Block or delete cookies in your browser settings.
- Use tools offered by the companies themselves, such as Google’s Ad Settings, Meta’s ad preferences, the Google Analytics Opt-out Browser Add-on, or the Digital Advertising Alliance’s WebChoices tool at optout.aboutads.info.
Global Privacy Control and Do Not Track
If your browser or extension sends a Global Privacy Control (GPC) signal, we treat it as a valid request to opt out of the sale and sharing of your personal information and of targeted advertising for that browser or device. If you are signed in to your account or we can otherwise reasonably link the browser to you, we also apply the opt-out to your customer record. The Site will show that your opt-out preference signal has been honored.
Some browsers offer an older “Do Not Track” setting. Because there is no common standard for how websites should respond to it, the Site does not respond to Do Not Track signals. We do honor GPC as described above.
Site analytics and shopping-cart activity (our own, first-party)
Site statistics. To understand how our store is used, our own website (not a third-party analytics service) counts page visits in aggregate. For each page view we record the page address, the previous page on our site (if any), the domain name of the website that referred you (for example, “google.com” — not the full address you came from), campaign tags included in the link you followed (utm_source, utm_medium, utm_campaign), whether that link carried an advertising or shopping click identifier (we record only its type, such as “gclid” or “srsltid”, never its value), your device category (mobile, tablet, or desktop), and how long the page was open, how far you scrolled, which sections were on screen, and which product links you pointed to or tapped. These are stored only as daily totals, without any identifier, so they cannot be linked to you or to each other. We do not set cookies for this, we do not use device fingerprinting, and the data stays on our hosting provider’s servers. Daily totals are deleted after 180 days. Your browser tab also keeps a note of how you arrived (in session storage, cleared when you close the tab); it is sent to us only if you add something to your cart, as described below.
Shopping-cart activity. If you add a product to your cart, WooCommerce creates a shopping-cart session, identified by a functional cookie that is necessary for the cart to work. While your cart session exists, we keep with it a short list of the store pages you visited after adding an item (including search terms you entered on our site), the products you added or removed, whether you reached the cart and checkout pages, the type of device you used, and how you first arrived at our site (the referring domain and campaign tags described above). To connect that first visit to your cart, the browser tab you are using remembers how you arrived (in your browser’s session storage, which is cleared when you close the tab); this is sent to us only after your cart has items in it. The cart session and this list are deleted automatically after 48 hours. If you place an order, the list is saved with your order record and kept for as long as we keep order records. We use this information only to understand where shoppers have difficulty and to improve our store; we do not sell it, share it, or use it for advertising. Information you type into the checkout form is kept in the same cart session for up to 48 hours even if you do not complete your order.
Order source. Our store software (WooCommerce) uses first-party cookies whose names begin with “sbjs_” to remember how your visit began — for example the referring website, campaign tags, device and browser type, and number of pages viewed. If you place an order, this information is stored with your order record.
IP addresses. We do not store your IP address for site statistics or cart activity. To protect the site from automated abuse, we shorten your IP address (removing its last part), convert the shortened address into a one-way code that changes every day, and keep that code for 10 minutes. As part of normal order processing, our store software records the IP address used to place an order to help prevent fraud.
Global Privacy Control and Do Not Track. We honor the Global Privacy Control (GPC) and Do Not Track (DNT) signals. If your browser sends either signal, our site does not record any of the site statistics or shopping-cart activity described above, and the order-source cookies are not set. Your cart and checkout work normally. We note only that the signal was present, so that your cart is not mistaken for automated traffic. To learn how to turn on GPC, visit globalprivacycontrol.org.
6. How long we keep personal information
We keep personal information only as long as needed for the purposes described in this policy, including legal, tax, and accounting requirements. In general:
- Order, payment, and tax records: generally up to 7 years after the end of the tax year in which the order was placed, as required for tax and accounting purposes.
- Customer accounts: until you close your account or ask us to delete it. We may delete accounts that have been inactive for 3 years. Order records are kept as described above.
- Marketing email list: until you unsubscribe. After that, we keep a minimal record of your email address and opt-out so that we do not email you again, and a record of your original consent for as long as needed to show we had it.
- Customer service communications: up to 3 years after our last contact with you.
- Site statistics (our own, first-party): stored only as daily totals without identifiers and deleted after 180 days. Third-party analytics data, if such tools are enabled in the future: up to 14 months.
- Cart and session data: WooCommerce shopping-cart session data, including the cart-activity list described in Section 5, expires within 48 hours; if you place an order, that list is kept with your order record.
- Security and fraud-prevention records: as long as reasonably needed to protect the Site and our customers, or longer if needed for an investigation or legal claim.
7. Your privacy rights and choices
Several U.S. states give their residents privacy rights, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. We extend the rights below to all of our U.S. customers, regardless of where you live, subject to the exceptions allowed by law (for example, we must keep certain order records for tax purposes).
- Right to know and access: ask what personal information we have about you, the categories of sources, the purposes for using it, the categories of third parties we disclosed it to, and get a copy of the specific pieces of information.
- Right to correct: ask us to correct inaccurate personal information.
- Right to delete: ask us to delete personal information we collected from you or about you.
- Right to data portability: receive your personal information in a portable, commonly used format.
- Right to opt out of sale, sharing, and targeted advertising: tell us not to sell or share your personal information or use it for targeted advertising.
- Right to opt out of profiling: we do not engage in profiling that produces legal or similarly significant effects about you.
- Right to limit the use of sensitive personal information: we use sensitive personal information only for purposes permitted by law (such as securing your account), so no further limit is needed, but you may contact us with questions.
- Right to a list of third parties: where state law provides it (for example, Oregon, Delaware, Maryland, and Minnesota), ask for a list of the specific third parties, or categories of third parties, to which we have disclosed personal information.
- Right to non-discrimination: we will not deny you goods, charge you a different price, or provide a different level of service because you exercised your privacy rights. Our email welcome discount is a financial incentive described in Section 8.
- Right to appeal: if we decline your request, you may appeal our decision (see below).
How to submit a request
- Email contact@factoval.com with the subject line “Privacy Request,” or
- Call (551) 401-4841, or
- For opt-outs, use the “Your Privacy Choices” link at the bottom of every page or turn on Global Privacy Control.
Please tell us your name, the email address you used with us, your state of residence, and what you are asking for. To protect your information, we will verify your identity by matching the information you give us with our records (for example, your email address and an order number). We may ask for more information if needed, but we will never ask for your Social Security number. You do not need an account to make a request. Opt-out requests do not require verification.
Authorized agents: you may use an authorized agent to make a request for you. We will ask the agent for written permission signed by you (or a valid power of attorney) and may ask you to verify your identity directly with us.
Timing: we will confirm receipt of a request within 10 business days and respond within 45 calendar days. If we need more time, we may extend this by up to another 45 days and will tell you why. We process opt-out requests as soon as feasible and no later than 15 business days after receiving them. Requests are free of charge unless they are manifestly unfounded, excessive, or repetitive, as allowed by law.
Appeals: if we decline all or part of your request, you may appeal by replying to our decision or emailing contact@factoval.com with the subject line “Privacy Appeal.” We will respond in writing within the time required by your state’s law (generally 45 to 60 days) and explain our reasons. If you are not satisfied with the result of your appeal, you may contact your state’s Attorney General.
Marketing emails
You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting us. We will process your request within 10 business days. Even after you unsubscribe, we will still send you messages about your orders and account.
Reviewing and updating your information
If you have an account, you can review and update your contact details and saved addresses in your account dashboard. You can also ask us to update your information by contacting us.
California residents
- This policy describes the categories of personal information we collect, the purposes for which we use it, whether it is sold or shared, and how long we keep it, as required by the California Consumer Privacy Act.
- “Shine the Light” (Cal. Civ. Code § 1798.83): we do not disclose personal information to third parties for their own direct marketing purposes. California residents may ask us about this once per calendar year by contacting us.
- This policy is available in an alternative format on request. Contact us and we will provide it in a format you can access.
Nevada residents
We do not sell “covered information” as defined under Nevada law. Nevada residents may still submit an opt-out request by emailing contact@factoval.com.
8. Notice of financial incentive: email welcome discount
We offer new email subscribers a one-time code for 10% off their first order. This may be considered a “financial incentive” under California law.
- Material terms: the full terms are in our Newsletter Offer Terms.
- Personal information involved: your email address, the date, time, and page of sign-up, your consent record, and limited technical information (such as IP address) used to prevent abuse.
- How to opt in: enter your email address in our sign-up form and agree to receive marketing emails.
- How to withdraw: unsubscribe at any time using the link in any marketing email or by contacting us. A code already issued remains valid until it expires.
- Value of your data: we estimate that the value of your email address and permission to send you marketing emails is reasonably related to, and approximately equal to, the value of the discount you receive (10% of the merchandise subtotal of your first order; for example, $4.00 on a $40.00 order). We based this estimate on the expected cost of the discount compared with the expected revenue and marketing expenses connected with our email program.
9. How we protect personal information
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted (HTTPS) connections, payment processing by Stripe (a PCI DSS-certified Level 1 service provider), limited access to personal information for staff and providers who need it, and strong authentication for administrator accounts. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If you create an account, please use a strong, unique password and keep it confidential. If a security incident affects your personal information, we will notify you as required by law.
10. Children
The Site is not directed to children, and our products are not intended for children. You must be at least 18 years old to buy from us. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share personal information of consumers under 16. If you believe a child has given us personal information, please contact us and we will delete it.
11. Third-party websites and content
The Site may link to websites or documents we do not control, such as manufacturer websites, Safety Data Sheets, and social media pages. This policy does not apply to those websites. Please review their privacy policies.
12. Where we process personal information
We sell only to customers in the United States. We and our service providers may access, store, and process personal information in the United States and in other countries where we or our providers operate. Those countries may have privacy laws that differ from the laws where you live, and personal information stored there may be accessible to courts and authorities in those countries under their laws.
13. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page and change the “Last updated” date at the top. The updated policy takes effect on that date. If we make a material change to how we use or disclose personal information we have already collected, we will notify you by email or by a prominent notice on the Site before the change takes effect, and we will obtain your consent where the law requires it.
